Office Ride is a platform through which Employees can prebook his travel to and from office on defined shuttles which operates on a predefined route and schedule. Employees will be able to book their seats after successful payment of the fare defined for the routes. Post booking , employees will be
able to track the vehicle once its live.
These terms govern your use of the App, and contain important information, including provisions that limit our liability to you (“Terms”). Please read them carefully before agreeing.
This App relies on data from you and your mobile device [and may also rely on information from your vehicle, such as location and driving characteristics], so that we can deliver to you, great functionality, services, and communications tailored to your interests. Please see our Privacy Policy (as provided below) for more information.
By clicking “Accept” in the App or using the App, you represent that you are at least the age of majority and you agree to be bound by these Terms.
GENERAL INFORMATION
1. General
This App is owned by Ford Smart Mobility India Private Limited, Campus 1-B, Fifth Floor, RMZ Millennia Business Park, 143, MGR Salai, North Veeranam Salai, Kandhanchavady, Perungudi, Chennai (hereinafter “Ford”, “we”, “us”, “our”). Further, the terms "you", "your", "yourself" refer to the users of the App. These Terms do not alter in any way the terms of any other agreement you may have with us.
2. Profile Information
The App allows you to set profile and preference information. You can also authorize other users to create their own profiles that will be linked to your account. You are responsible for all use by and through anyone you may authorize under your account. If you authorize anyone under 18 years of age, they may use your account only under your supervision. If we decide any username created by you to be profane or obscene, we reserve the right to remove or discontinue your use of the App.
3. Account Security
You are responsible for securing your login information, and for any activity, whether authorized or not, that occurs under your account. You are solely responsible for maintaining the confidentiality of your login information and will be liable for all activities and transactions that occur through your account on the App, whether initiated by you or any third party. We shall not be liable for any loss that you may incur as a result of someone else using your login information or your account, either with or without your knowledge. You agree to notify us immediately of any unauthorized use of your account or password.
4. Changes to the App and Terms
We may modify these Terms at any time at our sole discretion. We will alert you through the App of any material changes to these Terms, and allow you an opportunity to accept the modified Terms. Unless otherwise specified by us, revised Terms will take effect automatically and be binding from the day they are posted on the App.Your continued use of the App or its features will indicate your acceptance of the modified Terms. We reserve the right to update, modify, suspend, or discontinue the App or any of its features or functions at any time without any notice or obligation to you.
5. System Requirements/Updates
Use of the App requires a compatible mobile device, internet access, and software. You may need to obtain updates or upgrades from time to time. Contact your provider regarding applicable data rates and fees.
6. Feature Availability
Not all features or services are available in all markets and coverage may be limited, including due to mobile device or vehicle capability and network coverage. Availability of features is subject to change. The App may be unavailable or interrupted from time to time for a variety of reasons, such as environmental or topographical conditions, network coverage, or technical
7. Uninstalling the App
To uninstall the App, use the application management tools provided with your device or consult your device manual for assistance.
COMMUNICATIONS
If you communicate with us, you expressly consent to our representatives contacting you in the manner you request. You can choose whether or not to receive push notifications in your App settings. You may opt-out of receiving App marketing emails by unsubscribing to the emails.
REWARDS AND CASHBACKS
1. Ford from time to time may provide incentives in the form of closed wallet cashback to users who qualify for the same upon completion of certain activity. To that extent, the cashback is a guaranteed discount.
2. By agreeing to use the App and receive cashbacks, You agree to the below terms and conditions:
- Ford reserves the right to provide cashbacks as discounts to its users as per internal policies as decided by Ford from time to time.
- For cashbacks, all the terms and conditions applicable to cashback award and usage will continue to apply.
- Ford reserves the right to employ reasonable technological and other methods to prevent abuse of the cashback offers. Further, You acknowledge that Ford’s decision to take certain actions, including limiting access to your offer, placing holds or imposing reserves, may be based on confidential criteria that is essential to our management of risk, the security of users’ accounts, comply with applicable laws and the otherwise protect the App and its ecosystem. You agree that Ford is under no obligation to disclose the details of its risk management or its security procedures to You.
- If you are eligible for a cashback, the cashback amount shall be credited to your App Wallet which is a closed wallet and can only be used to purchase rides and passes in the App.
- Ford may use your personal information for promotional purposes without additional consent from or compensation to you.
- Cashback reward offers linked to chance and luck are not available in the state of Tamil Nadu (owing to the Tamil Nadu Prize Scheme (Prohibition) Act 1979) and other states wherever prohibited by law.
- Your participation in any offer constitutes your understanding and agreement to the complete terms and conditions associated with each offer.
3. If You are entitled for cashback, You agree to receiving the same as an online gift voucher. The gift vouchers will be valid for 1 year and is subject to a maximum limit of Rs.10,000 per gift voucher. Ford reserves the right to extend the validity period of your vouchers at its discretion.
4. Ford reserves the right to impose additional amount limits within the overall applicable limit.
5. In case of any cancellations, the cashback given on the transaction will continue to remain as gift voucher balance and non-withdrawable to your bank account. This can continue to be used on the App. Refunded amount less of cashback will be credited back to the source of funds used while making payment.
6. Cashback gift voucher cannot be withdrawn to any linked bank account or transferred to other customers. 7. A user can earn up to maximum INR 9,999 per financial year (i.e. 1 April to 31 March) across all offers disbursed on the App.
THIRD PARTY MATERIALS
1. Third Party Services
This App may contain links to third party websites or services not owned or controlled by us, including links to websites of our suppliers (“Third Party Services”). We have no control over and, to the fullest extent permitted by applicable laws, assume no responsibility for, the content, privacy policies, or practices of any Third Party Service.
In addition, Ford will not and cannot censor or edit the content of any Third Party Service. We assume no responsibility for examining or evaluating the products and services offered by them, and we do not warrant the offerings of or the content of such Third Party Services. We do not in any way endorse the contents of any Third Party Services. By clicking on links, you expressly relieve us from any and all liability arising from your use of any Third Party Services, or from the content of any Third Party Service. In no event shall we assume or have any responsibility or liability for any content posted or for any claims, damages or losses resulting from use of content of any Third Party Service.
Your correspondence or business dealings with, or participation in promotions of Third Party Services, found on or through the App, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such Third Party Services. We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings of yours with such Third Party Services.
Third Party Services that may appear on this App and all rights therein are reserved to the registered owners of those trademarks. For use of any intellectual property associated with such Third Party Services, you need to get permission directly from the owner of the intellectual property for any use.
Please be aware of when you leave this App, please read the terms and conditions and privacy policy of each Third Party Service that you visit.
2. Open Source and Third Party Software
The App may contain or rely in part on certain free, shared, or public library software (“Open Source Software”). Please refer to the posted Open Source Software acknowledgements in Part 5 of these Terms.
LIMITED LICENSES
The App and any software, data, media, images, logos, music or other content made available through or in connection with the App (including via App-related websites) (collectively “App Content”) are owned, controlled or licensed by us or are used under license. The App Content is protected by worldwide copyright, trademark, patent, trade secret, or other proprietary rights, laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of the App and the App Content, and to prevent any unauthorized copying of the App Content. Except as express
You shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by use of the App or App Content.
Your use of the App Content is subject to the following restrictions:
1 - you may not, nor allow any third party, to create derivative works of the App Content, use any data mining, robots, or similar data gathering and extraction tools on the App Content, create a database, systematically download, store any or all of the App Content other than as licensed above, link or frame any portion of the App Content, extract, derive or attempt to extract or derive any source code or structure of all or any portion of the App Content by reverse engineering, disassembly, decompilation or any other means;
2 - you may not, nor allow any third party, to copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit or distribute in any way (including "mirroring") to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without our express prior written consent or unless expressly provided in these Terms.
3 - you shall not interfere with another user's use and enjoyment of the App or App Content and shall not host, display, upload, modify, publish, transmit, update or share any information that belongs to another person and to which You do not have any right to;
4 - you may not use the App or App Content, with other content or in a manner that is unlawful, abusive, defamatory, deceptive, or invasive of another’s privacy, nor may you abuse anyone on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;
5 - you may not use the App Content with other content or in a manner that impersonates any person, business or entity, including us;
6 - you may not interfere with, try to interfere with, disrupt, or try to disrupt our servers or networks, or disobey any network access or security requirements;
7 - you may not use the App or App Content in such a manner such that it infringes upon or violates any third party's rights, (including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity;tent in conjunction with adult content or content that otherwise promotes illegal activities, gambling, or the sale of tobacco or alcohol.
8 - you may not use the App or App Content as a means to engage in conduct that reflects poorly upon or disparages our reputation or goodwill; and
9 - you may not use the App or the App Content in conjunction with adult content or content that otherwise promotes illegal activities, gambling, or the sale of tobacco or alcohol.
If you are not the bill payer for the mobile phone or handheld device which is being used to access the App, you will be assumed to have received permission from the bill payer to use the App or any of its features.
You shall not engage in advertising to, or solicitation of, other users of the App to buy or sell any products or services, including, but not limited to, Third Party Services being displayed on or related to the App. You may not transmit any chain letters or unsolicited commercial or junk email to other users via the App. It shall be a violation of these Terms to use any information obtained from the App in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person outside of the App without our prior explicit consent.
You shall not probe, scan or test the vulnerability of the App or any network connected to the App nor breach the security or authentication measures on the App or any network connected to the App. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the App, including details of accounts not owned by you, to its source, or exploit the App or App Content, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided on the App.
You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the App or our systems or networks, or any systems or networks connected to the Ap
You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about us or the brand name or domain name used by us or otherwise engage in any conduct or action that might tarnish the image or reputation, of Ford on platform or otherwise tarnish or dilute any of our trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us.
Subject to your continued compliance with these Terms and any other terms communicated in connection with specific App Content, we grant you a non-exclusive, non-transferable, limited right to access, view, use, display and listen to the App Content for your personal, non-commercial use only. You agree not to dispute our claims of ownership or validity of our rights in the App Content.
If you violate any of the Terms, your rights will immediately terminate and we may terminate your access to the App without notice and without any refund of fees, if applicable.
TRADEMARK NOTICE
The Ford name, and all trademarks and logos displayed on the App are owned or used under license by us. The unauthorized use of any trademark displayed on this App or included in any App Content is strictly prohibited and we shall have the right to initiate infringement proceedings against you, for such unauthorized use.
INTERFERENCE
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE THIS APP OR OTHERWISE UNDERMINE OUR LEGITIMATE BUSINESS OPERATIONS MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WE RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW

INDEMNITY
By using this App you agree that you will defend, indemnify and hold harmless us and our subsidiaries and affiliates, our respective distributors, dealers, dealer associations, suppliers, licensors, partners and advertising and promotion agencies, from and against all the liabilities, claims, damages and expenses (including reasonable attorneys' fees and costs) arising out of any use of this App by or through you including any of its features or services, your breach or alleged breach of these Terms, and/or your breach or alleged violation of the patent, copyright, trademark, proprietary or other rights of third parties. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and, in such case, you shall agree to cooperate with our defense of such claim.
You acknowledge and agree that your app store provider has no liability, responsibility or obligation to you, including with respect to the investigation, defense, settlement or discharge of a third party’s intellectual property infringement claim.
LIMITATION OF OUR LIABILITY
i) We disclaim all warranties, express or implied, in connection with the App and your use thereof, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
ii) WE, OUR INFORMATION PROVIDERS AND THEIR AGENTS ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY:
(b) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE APP INCLUDING DUE TO THE USE OF A VEHICLE AND ANY ACCIDENT OR BREAKDOWN OF THE VEHICLE
(c) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN (d) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO/FROM THE APP
(e) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO/THROUGH THE APP BY ANY THIRD PARTY AND/OR
(f) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND, INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE APP
iii) WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE APP OR ANY HYPERLINKED WEBSITE OR APP, OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR ANY TRANSACTION BETWEEN YOU AND THIRD PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE. NEITHER WE, NOR OUR INFORMATION PROVIDERS OR THEIR AGENTS ARE PROVIDING ANY LEGAL, TAX, MEDICAL, COUNSELLING, ACCOUNTING, INVESTMENT, FINANCIAL OR ANY OTHER PROFESSIONAL SERVICES OR ADVICE.
iv) IN NO EVENT SHALL WE, OR OUR OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SHAREHOLDERS, REPRESENTATIVES OR AGENTS BE LIABLE FOR ANY, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF INCOME, PROFITS, GOODWILL, DATA, OR USE OF MONEY, WHETHER IN TORT (INCLUDING AND WITHOUT LIMITATION, NEGLIGENCE), CONTRACT OR OTHERWISE, ARISING OUT OF OR RELATED TO ANY ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE APP OR ANY OF ITS FEATURES, FUNCTIONALITIES, CAPABILITIES OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This section does not affect, and is not intended to affect, any rights that a consumer has that are not able to be excluded under applicable consumer laws
The App or any of its features may be unavailable or interrupted from time to time and may tend to be inaccurate at times, for reasons outside of our control. We are not responsible for any interruptions or errors in the App or its features. The App and all the information accessible through it are provided for information purposes on an “as is” and “as available” basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, uninterrupted access, timeliness, sequence, quality, performance, security, merchantability, fitness for any particular purpose, noninfringement or completeness, the operation of, information, materials, content, availability, and products with respect to the App.
Without prejudice to the forgoing paragraph, We do not warrant that:
ii) the information on this App is complete, true, accurate or non-misleading or
iii) this App, information, App Content, materials, product (including software) or services included on or otherwise made available to you through the App, their servers or electronic communication sent from us are free of viruses or other harmful components.
INDIAN APP AND PRICING
Ford operates this App from India. You agree that all notices, legal documents, proceedings, etc. will be in the English language.
Materials and information provided on or through the App, including but not limited to prices, features, products or services, may not be appropriate for use outside India or available outside India. If you choose to access the App from outside India, you do so at your own initiative and are responsible for compliance with applicable laws.
You agree to comply with all export and re-export laws, restrictions and regulations of your government in connection with your use of the App.
Further, because Ford is based in India, you represent and warrant that:
(ii) that you are not listed on any list of prohibited or restricted parties published by the Government of India.
If vehicles are depicted in this App, it in no way constitutes an offer to buy or sell vehicles from Ford or to provide financing or leasing. Any prices, product specifications and all other information shown on this App are for information purposes only, are subject to change at any time without obligation, may vary from region to region, and may not be completely up to date or accurate. Optional equipment is not included unless specifically indicated. Any calculation of any price, tax, incentive, lease or finance terms is for your reference only, and is an estimate which may not be completely accurate.
CONSENT TO RECEIVE AUTODIALED MARKETING TEXT MESSAGING AND CALLS
Ford autodialed texts are text messages that Ford sends using equipment that can dial numbers that are stored or produced by random or sequential number generators. By consenting to receive an autodialed text, or regular receipt of autodialed texts (in the case of a subscription), that contain ads from Ford, whether by replying “Y” to a Ford text message or by registering your consent online, you agree that Ford may deliver or cause to be delivered, autodialed telemarketing text(s) to the phone number you have provided, or in the case of a text consent, the number associated with your device. You are under no obligation to accept these Terms and agreeing to receive autodialed telemarketing text(s) is not required for purchasing any property, goods, or services from Ford.
Ford may call you via voice calls regarding your rides or for marketing purposes. You agree to expressly authorize Ford to make service-related telephone voice calls, even your number is listed as DND with the concerned telecom regulatory authority. You can opt out of receiving voice based telephone calls from Ford either by disabling the same in Account Settings or by informing our customer service representative of the same
MISCELLANEOUS
These Terms, together with any additional terms that govern particular elements of the App, constitute the entire agreement regarding the App.
These Terms are governed by, and construed in accordance with, the laws of the Republic of India (except in relation to any conflict of law provisions thereof), except to the extent local laws require otherwise.
Unless local laws mandate otherwise, all lawsuits arising from or relating to the App or these Terms shall be brought in the courts located in Chennai, Tamil Nadu, India.
If a court determines that any term or condition in these Terms is illegal or unenforceable, then such term will be eliminated and the remaining terms and conditions will remain in full force and effect.
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

MAP-BASED GUIDANCE/ LOCATION-BASED SERVICES USING THIRD PARTY DATA
YOUR USE, OF THIS REAL TIME ROUTE GUIDANCE APPLICATION, IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.
Location data as well as any maps data provided by this App is for basic location and navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, damage to property or environmental damage.
The App may use data from third party sources, such as maps and directions, google maps in our case to provide services. This data and other information may not always be accurate. Terms applicable to location based services to which you will be bound by using The App include:

MOBILE PAYMENTS / MY WALLET
The following terms (“Mobile Payment Terms”) apply to the mobile payment features of the App, which allow you to complete payment transactions through the App using your PayTM account. We generally refer to PayTM as the “Mobile Payment” features. The Mobile Payment features are maintained and operated by third party payment service providers.
By clicking “I accept,” you:
- agree to be bound by these Mobile Payment Terms;
- represent that you are 18 years of age or older and capable of entering into a legally binding agreement; and
- authorize Mobile Payment features to verify the validity of your PayTM account and to process and transmit your PayTM account details to facilitate transactions as described below.
We may modify the Mobile Payment Terms at any time. We will alert you through the Apps of any material changes to the Mobile Payment Terms, and allow you an opportunity to accept the updated terms. Modifications will be effective immediately upon being posted on the App or on a future date as we may specify, and your continued use indicates your acceptance of the modified Mobile Payment Terms.
If you do not agree to the Mobile Payment Terms or any modifications to the Mobile Payment Terms or features, your only option is to stop using the Mobile Payment features.
We reserve the right to update, modify, suspend, or discontinue any part of the Mobile Payment features at any time without any notice or obligation to you. Mobile Payment features may not be available during maintenance breaks and other times.
1. Account Registration
To use the Mobile Payment features, you must register a valid PayTM account. All information provided during registration must be current, accurate and complete.
You authorize the Mobile Payment features to confirm that your PayTM account is sufficiently funded to pay for the trip booking and to deduct funds from your PayTM account when booking a trip.
2. How Mobile Payments Work / Our Role
The Mobile Payment features let you make payments using your PayTM account. You authorize PayTM to collect, analyze and relay information generated in connection with purchases that you make with the Mobile Payment features (“Transactions”). Transactions are subject to the terms and conditions governing your PayTM account and to any agreements between you and PayTM. We are merely facilitators of the Mobile Payment features. If your payment transaction using PayTM is marked as “pending” on the App owing to technical outage or load spikes, we will confirm your booking based on the pending status shown in the App. If the transaction status moves to “failure” or “declined” from the Mobile Payment, you are obliged to pay the fare for such transaction. By agreeing to these terms and conditions, you agree to clear your outstanding balance using the Mobile Payment before requesting the next ride. If a fare has “failed” or has been “declined”, the amount for the failed transaction will be refunded back by the Mobile Payment to your account in accordance with the Mobile Payment terms and conditions.
3. Transaction History
When you make a payment with the Mobile Payment features, we will update your activity in the App. The Transaction History screen will display the last 5 trips that have been completed. The Transaction confirmation will serve as your receipt and the Transaction also will appear on your PayTM account. Except as otherwise required by law or by the terms of another agreement between us, you are solely responsible for:
1 - Compiling and retaining permanent records of all Transactions and other data associated with your use of the Mobile Payment features; and
2 - Reconciling all transactional information that is associated with the Mobile Payment features. If you believe that there is an error or unauthorized Transaction activity, you agree to contact us immediately.
4. Refunds
Except in the event of an uncompleted ride owing to vehicle breakdown, accident or driver missing the stop, all Transactions are non-refundable and non-reversible. You may have additional refund or charge-back rights based on a Merchant’s policies or under your Payment Card issuer agreement or applicable laws. You should review your periodic statement received from the issuer of your Payment Card to verify your Transactions.
5. Customer Service
We provide customer service for issues relating to how the Mobile Payment features work. For issues related to your PayTM account, contact PayTM directly.
6. Suspension or Terminatio
We may suspend or terminate your access to the Mobile Payment features for any reason or no reason at any time upon notice to you. Without limiting the foregoing, we may also suspend your access to any to the App or terminate your account if:
(ii) you pose an unacceptable fraud risk to us;
(iii) You fail to remit or maintain payments:
(iv) you provide any false, incomplete, inaccurate, or misleading information or otherwise engage in fraudulent or illegal conduct; or
(v) we notice suspicious activity.
7. Effect of Termination
We will not be liable to you or any third party for compensation, reimbursement, or damages in connection with your use of the Mobile Payment features, or any termination or suspension of the Mobile Payment features or your access to it, including with respect to any deletion of your information or account data. In the event of termination, any incomplete trip will also stand canceled and your booking amount will also be refunded back to your PayTM account. If your Mobile Payment account is terminated for any reason or no reason, you agree:
(i) to continue to be bound by the Mobile Payment Terms and remain responsible for any Transactions you have processed through the Mobile Payment features;
(ii) to immediately stop using the Mobile Payment features;
(iii) that the license provided under the Mobile Payment Terms shall end; and
(iv) that we reserve the right (but have no obligation) to delete all of your information and account data stored on our servers.
8. Liability
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE MOBILE PAYMENT FEATURES IS AT YOUR OWN DISCRETION AND RISK, AND NONE OF FORD, OR IT’S EMPLOYEES AND SUPPLIERS, OR THE PAYMENT SERVICE PROVIDERS ARE RESPONSIBLE FOR ANY DAMAGES THAT RESULT FROM YOUR USE OF THE MOBILE PAYMENT FEATURES, INCLUDING AND WITHOUT LIMITATION, ANY FAILURE TO COMPLETE TRANSACTIONS IN ACCORDANCE WITH YOUR INSTRUCTIONS.
9. Indemnity and Release
By using the Mobile Payment features, you agree that you will defend, indemnify, release and hold harmless us and our subsidiaries and affiliates, their respective distributors, dealers, dealer associations, suppliers, licensors, partners and advertising and promotion agencies, from and against any liabilities, claims, damages and expenses (including reasonable attorneys’ fees and costs) arising out of any use of the Mobile Payment features by or through you, your breach or alleged breach of the Mobile Payment Terms, or your violation or alleged violation of the patent, copyright, trademark, proprietary or other rights of third parties. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and, in such case, you shall agree to cooperate with our defense of such claim.
You acknowledge and agree that your app store provider has no liability, responsibility or obligation to you, including with respect to the investigation, defense, settlement or discharge of a third party’s intellectual property infringement claim.
10. Miscellaneous
To use the Mobile Payment features, you must register a valid PayTM account. All information provided during registration must be current, accurate and complete.
You authorize the Mobile Payment features to confirm that your PayTM account is sufficiently funded to pay for the trip booking and to deduct funds from your PayTM account when booking a trip.
11. SMS notifications
You agree to receive SMS messages to confirm any transactions done on the application (including, but not limited to: booking/cancellation of rides, purchase of passes, rescheduling, etc.). You can opt out of receiving SMS at any time by changing the settings in Account Settings. By default, the option to receive SMS will be enabled.
12. Account Authentication
You agree to providing sms authentication when logging in from a third-party site into the App. A sms One Time Password (OTP) will be required for you to log into your App account from your mobile phone handset. The OTP generated will be delivered to Your mobile phone handset through an SMS network. This OTP received and inputted will then be compared to the OTP value generated, and if the values match, the log-in to the App will be validated. The SMS OTP credential is anonymous and only provides an authentication factor

Solely to enable Us to use the information so that We are not violating any rights You might have in Your Information, You agree to grant Us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, database rights or any other rights You that you may have in Your Information, in any media now known or not currently known, with respect toYour Non-Personal Information and with respect to Your Personal Information, till the time we are entitled to retain such Personal Information (as provided below).
Ford is/are concerned about the privacy of the data and information of users (including sellers and buyers/customers whether registered or non-registered) accessing, offering, selling or purchasing products on Ford’s website, mobile sites or mobile applications (“Application”) on the Application and otherwise doing business with Ford.
The terms "We" / "Us" / "Our"/"Ford" refers to Ford (as defined in clause 1.1 of Part 1) and the terms "You" / "Your" / "Yourself" refer to the users, for the purpose of this privacy policy.
This Privacy Policy is a contract between You and Ford whose Application , You use or access or You otherwise deal with. This Privacy Policy will be read together with the ‘Terms’ with respect to usage of the Application.
Introduction
We respect Your privacy and are committed to protecting it. This privacy policy (“Privacy Policy”) explains our policies and practices regarding on-line seller/customer information. It is through this disclosure that We intend to provide You with a level of comfort and confidence in how We collect, use, and safeguard personal and other information that We collect or that You provide through this Application, and how You can contact Us if You have any questions or concerns. It is our sincere hope that by explaining our data handling practices, We will develop a trusting and long-lasting relationship with You.This Privacy Policy sets out our policies on the management of “Personal Information” (as defined below) and “Non-Personal Information”(as defined below) (collectively, “Information”), that is, how We collect Information, the purposes for which We use this Information and to whom this Information is disclosed.

The Information (which will also include data) which is provided by You to Ford or which is collected from You by Ford may consist of "Personal Information" and “Non-Personal Information”.
What is Personal Information?
“Personal Information” mean any information collected that can be used to uniquely identify or contact You. Personal Information for the purposes of this Privacy Policy will include, but not be limited to:ii) Your telephone number;
iii) Your e-mail address or other contact information;
iv) Your date of birth;
v) Your gender;
vi) Information regarding Your transactions on the Application, (including sales or purchase history);
vii) Your financial information such as PayTM account information or credit card or debit card or other payment instrument details;
viii) Any other items of "sensitive personal data or information" as such term is defined under the Information Technology (Reasonable Security Practices And Procedures And Sensitive Personal Data Or Information) Rules, 2011 enacted under the Information Technology Act, 2000;
ix) Identification code of Your communication device which You use to access the Application or otherwise deal with Ford;
x) Any other information that You provide during Your registration process, if any, on the Application.
How do We collect Personal Information?
When You use the Application, We will collect Personal Information about You if You provide it to Us voluntarily. You will provide Personal Information which will be collected in various ways including, during the course of:ii) registering as a seller on the Application;
iii) availing certain services offered on the Application. Such instances include but are not limited to making an offer for sale, online purchase, participating in any online survey or contest, communicating with Ford's customer service by phone, email or otherwise or posting user reviews on the items available on the Application; or
iv) otherwise doing business on the Application or otherwise dealing with Ford.
We may receive Personal Information about You from third parties, such as social media services, commercially available sources and business partners. If You access Application through a social media service or connect a service on Application to a social media service, the information We collect may include Your user name associated with that social media service, any information or content that the social media service has the right to share with us, such as Your profile picture, email address or friends list, and any information that You have made public in connection with that social media service. When You access the Application or otherwise deal with Ford through social media services or when You connect the Application to social media services, You are authorizing Ford to collect, store, and use and retain such information and content in accordance with this Privacy Policy.
Do We collect any information other than Personal Information?
Ford may also collect information other than Personal Information (“Non-Personal Information from You through the Application when You visit and / or use the Application. Such information may be stored in server logs. This Non-Personal Information would not assist Ford to identify You personally.1.This Non-Personal Information may include:
ii) details of Your telecom service provider or internet service provider;
iii) the type of browser (Internet Explorer, Firefox, Opera, Google Chrome etc.);
iv) the operating system of Your system, device and the Application You last visited before visiting the Application; and
v) The duration of Your stay on the Application is also stored in the session along with the date and time of Your access.
2. Non-Personal Information is collected through various ways such as through the use of cookies. You can erase or choose to block these cookies from Your computer. You can configure Your computer’s browser to alert You when We attempt to send You a cookie with an option to accept or refuse the cookie. If You have refused to accept cookies by turning it off, You may be prevented from using certain features of the Application.
A “cookie” is a small text file that helps us in many ways to make Your visit to Our website more enjoyable and meaningful to You. For example, use of cookies avoid You from having to log in every time You come back to one of Our websites. They also allow us to tailor a website or advertisement to better match Your interests and preferences. There are different types of cookies, such as:
ii) "persistent" cookie: It is stored on Your computer's hard drive until a specified date, which could be tomorrow, next week, or 10 years from now. Persistent cookies stay on Your computer until either:
(b) they are overwritten with newer cookies; or

3. This Application will use third party to deliver Application functionality such as fulfilling Your request to purchase products from this Application, calculation of sales tax, credit card processing and Application functionality. In performing this function the third party may place a persistent cookie on Your computer or may gather Personal Information from You in order to facilitate processing of Your purchase.
4. This Application may use third party click tracking analytics tools such as Amplitude to capture click through statistics.
5. The Application may use spot light ads and web beacons which are site instrumentation tools that help Us to determine, for instance, whether a page has been viewed or not and, if so, how many times. When You ask Us to send You information on a promotion or a newsletter, We may use web beacons to establish how many of the emails are actually opened. In general, any electronic image viewed as part of a web page, including an ad banner, can act as a web beacon.
6. You may be directed to the Application via banner ads or site links. Ads or site links that are placed by the Application, use cookies or web beacons to deliver metrics on the effectiveness of the ads or links. They do not collect Personal Information from you.
7. Third party advertising networks that serve ads onto the Application may use cookies and/or web beacons in their advertisements. The Application retains no control over such third party cookies and/or web beacons and does not have access to the information related to third party cookies and/or web beacons.
For what purposes do We collect, use, store and disclose Your Information?
Ford collects, uses, stores and processes Your Information for any purpose as may be permissible under applicable laws (including where the applicable laws provide for such collection, usage, storage or processes in accordance with your consent) connected with a function or activity of Ford and will include the following:
i) to facilitate Your use of the Application (lead generation, send marketing or promotional materials, including but not limited to, those sent through e-mail or through cell phone such as text message as requested by You, or send any other information);
ii) to respond to Your inquiries or fulfil Your requests for information about the various products and services offered on the Application;
iii) to provide You with information about products and services available on the Application;
iv) to send You important information regarding the Application, changes in terms and conditions, user agreements and policies, and/or other administrative information;
v) to send You surveys and marketing communications that Ford believes, may be of interest to You;
vi) to help in enhancing customer experience around the application and to identify popular features;
vii) to allow us to update our Application in order to better meet user wants and needs;
viii) to personalize Your experience on the Application by presenting advertisements, products and offers, tailored to Your preferences;
ix) to help You address Your problems incurred on the Application including addressing any technical problems;
x) to complete and fulfil your purchase (for example, by sending you SMS when buying passes, booking/cancelling rides, etc) communicate with you regarding your purchase and provide you with related customer service, if you purchase any product from the application.
xi) for proper administration of the Application;
xii) to conduct internal reviews and data analysis for the Application (for example, to determine the number of visitors to specific pages within the Application);
xiii) to improve the services, content and advertising on the Application;
xiv) to analyze how Our services are used, to measure the effectiveness of advertisements, to facilitating payments;
xv) to protect the integrity of the Application;
xvi) to respond to legal, judicial, quasi-judicial processes and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law;
xvii) to generate site analytics that improve the layout, content, product offerings and services on the Application;
xviii) to compile user data that is stored in Our corporate database and which may be used for marketing and other purposes;
xix) to permit third parties who may need to contact users who have bought products from the Application, to facilitate installation, service and any other product related support;
xx) to implement information security practices;
xxi) to determine any security breaches, computer contaminant or computer virus;
xxii) to investigate, prevent, or take action regarding illegal activities and suspected fraud;
xxiii) to undertake forensics of the concerned computer resource as a part of investigation or internal audit;

xxv) to trace any computer resource or any person who may have contravened, or is suspected of having contravened or is likely to contravene, any provision of law including the Information Technology Act, 2000, that is likely to have an adverse impact on the services provided on the Application; and

What happens if You don't provide Information?
The primary reason behind collecting Information from You when You visit the Application is, to provide You the functionality and services that You need, in order to have a meaningful and customized experience while using the Application features. We need to collect Information in order to verify user identity, pre-populate fields for user convenience, fulfill purchase orders, and conduct surveys and targeted marketing campaigns, including honoring Your request to receive text messages or mobile alerts regarding special money-saving service coupons and promotional offers. This Application may use a third party to deliver site functionality.Whom do We share and disclose Information to?
1.Ford may transfer, share, disclose or part with all or any of Your Information, within and outside of the Republic of India, to other Ford entities (Ford Motor Company, USA and its other subsidiaries and affiliates), and to third party service providers for one or more of the Purposes or as may be required by applicable laws. In such case, We will contractually oblige the receiving parties of the Information to ensure the same level of data protection that is adhered to by Ford under applicable laws. The other Ford entities and third party service providers will adhere to confidentiality obligations which are consistent with this Privacy Policy. The third party service providers of the Application, who have access to Your Information in connection with providing services for the Application, are required to keep the Information confidential and are not permitted to use this Information for any other purpose than to carry out the services they are performing under the Application.2.Notwithstanding the above, We use other third parties such as credit/debit card processing companies, payment gateways, pre-paid cards etc., in order to enable You to make payments for products bought on the Application. When You sign up for these services, You may have the ability to save Your card details for future reference and faster future payments. In such case, We may share Your relevant Personal Information, as may be necessary, for the third parties to provide such services, including Your name, residence and email address. The processing of payments or authorization is solely in accordance with these third parties’ policies, terms and conditions and We are not in any manner responsible or liable to You or any third party for any delay or failure at their end in processing of the payments.
3.Ford may also share Information if Ford believes it to be necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or users of Ford or the public, or violations of various terms and conditions or violation of Our policies.
4.Ford reserve the right to disclose Your Information when required to do so by law or regulation, by order of a judicial authority, in response to a request from a law enforcement or governmental agency or judicial, quasi-judicial or any other statutory or constitutional authority, to establish or exercise Our legal rights or to defend against legal claims.
5.Ford will share Personal Information that You provide in the Application to its authorized suppliers such as vehicle drivers. Ford’s suppliers are not restricted by the Application in their use of Your Information.
6.Ford may use and share the metrics for the Application with other Ford websites, subsidiaries or affiliates. The information shared will be aggregate data and will not include any of Your Personal Information.
How do We link to other websites?
1.The Application provides links to other websites. We encourage You to review the privacy statements of all sites which You visit, including those links which are provided so that You can understand how those sites collect, use and share Your Information. The Application is not responsible for the privacy statements, content or data handling practices on other websites.2.The Application also contains vehicle locator services which are provided by a third party vendor. In order to provide You with the closest drivers, We may need to collect Your IP address in order to determine Your general location, or We may ask You to provide location information such as pin code or city and state. In the instance, where We use a third party vendor to provide passenger locator services, We shall provide them with Your pin code. We encourage You to review the terms of service and the privacy policies of the aforesaid service providers.
How do We protect Personal Information?
1.Safeguarding information of visitors to our website is important to us. We use systems, policies and procedures to maintain accuracy of information and to protect information from loss, misuse or alteration.2.When You provide Personal Information, such as credit card numbers or telephone numbers, on the Application we use Secure Socket Layers(“SSL”) to protect Your data. SSL is encryption technology that helps safeguard Your Personal Information against misuse by unauthorized individuals.
3.The third party service providers who have access to Your Personal Information, in connection with providing services for the Application, are required to keep the information confidential. The third party service providers of the Application are not permitted to use this information for any purpose other than to carry out the services that they are performing for the Application.
4.If You choose a payment gateway to complete any transaction on the Application then Your credit card data may be stored in compliance with industry standards/recommended data security standard for security of financial information such as the Payment Card Industry Data Security Standard (“PCI-DSS”).
5.Ford may share Your Information with third parties under a confidentiality agreement which inter alia provides that such third parties do not disclose the Information further, unless such disclosure is for any of the Purposes laid down above. However, Ford is not responsible for any breach of security or for any actions of any third parties that receive Your Personal Information. Ford is not liable for any loss or injury caused to You as a result of, You providing Your Personal Information to any third party (including on any third party websites, even if links to such third party websites are provided on the Application).
6.It is possible for others to obtain Personal Information about You on the public forum or any other website or app, and that the recipient may use such information to harass or injure You. We do not approve of such unauthorized uses but by using the App, You acknowledge and agree that, We shall not be responsible for the use of any Personal Information that You publicly disclose or share with others.
7.Notwithstanding anything contained in this Privacy Policy or elsewhere, Ford will not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).
8.A "Force Majeure Event" means any event that is beyond the reasonable control of Ford and will include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided it is beyond reasonable control of Ford), power or electricity failure or unavailability of adequate power or electricity.
9.While We shall endeavor to take all reasonable and appropriate steps to keep secure all Your Personal Information and prevent unauthorized access. You acknowledge that the internet or computer networks are not fully secure and that We cannot provide any absolute assurance regarding the security of Your Personal Information.
10.Ford will retain all Personal Information till such time, as required for any of the Purposes or required under applicable laws, whichever is later. Non-Personal Information will be retained indefinitely.
How can You access and correct Your Personal Information that We hold?
1.To correct or update Your Personal Information You are required to use the My Profile function. You will be asked for Your ID and password so that we may be able to process Your changes on the Application. We will use reasonable efforts to correct any factual inaccuracies in Your Personal Information.2.The scope of access available with respect to such request for correcting/updating Personal Information is for information stored in the database holding the data for the Application. Any Personal Information that has been collected from You on other Ford websites will not be accessible or changeable through the processing of the aforesaid request on this Application.

How are children’s rights protected?
The Application does not knowingly or intend to, collect Personal Information from children under 13 years of age. If a child has provided us with any Personal Information, a parent or guardian of that child may contact us at [email protected] , if they want such information deleted from our records. We shall then make reasonable efforts to delete the child's Personal Information from the database that stores information for the Application.Consent Policy
By visiting this Application or any functionality of the Application and by providing Your Personal Information to us, You understand, agree and consent:ii) that the Information so collected is for lawful purposes, in connection with a function or activity of Ford or any person on their respective behalf, and the collection of Information is necessary for the Purposes;
iii) that disclosure, sharing and transfer of Your Information will not cause any wrongful loss to You or to any third party, or any wrongful gain to Us or to any third party;
iv) that Ford will adopt reasonable security practices and procedures as mandated under applicable laws for the protection of Your Information. Provided that Your right to claim damages will be limited to the right to claim only statutory damages under Information Technology Act, 2000 and You hereby waive and release Ford from any claim of damages under contract or under tort;
v) that all Personal Information will be retained till such time required for the Purposes or required under applicable laws, whichever is later. Non-Personal Information will be retained indefinitely; and
vi) that You are providing Your Information out of Your free will. You have an option not to provide or permit Ford to collect Your Personal Information or later withdraw Your consent with respect to such Personal Information so provided herein, by sending an email to the grievance officer as may be notified to You.
2. Booking can be done only for next 5 days , booking will open every week on Saturday for the next week.
3. Ensure your PayTM account/ wallet has enough balance to pay for the seat you are booking on the Ride.
4. Seats once booked are not transferable to other people or to another Ride/ Schedule.
5. You will start tracking the Vehicle only 15 minutes before the start of a Ride.
6. Booking for a Ride will close 5 minutes before the scheduled reach time at a stop.
7. Users are allowed to cancel their Ride 10 minutes before the scheduled reach time of their stop without any penalty or cancellation fee.
8. No Vehicle will stop to pick up or set down any User at any point in the Ride other than the agreed pick up location and destination as per the booking done.
9. ETA shown is indicative and you are advised to be at the boarding point before the scheduled time.
10. ETA is subject to change based on traffic and real time conditions and should not be taken as the actual time of arrival of the Vehicle.
11. Please carry ID/valid proof of your identity to board the Vehicle as you might have to display to the driver on request.
12. You will not be entitled to a refund if you miss the Vehicle/ Ride.
13. We assure you that if we are unable to serve you due to reasons owing to Vehicle breakdown or our driver not stopping at your point, your booking amount will be refunded in its entirety.
14. In case of Emergency, tap the SOS button and our agent will contact you immediately and appropriate action will be taken .
15. Any changes in the routes and schedules will be communicated from time to time.
